Justice Between Multiple Wives: In Which Matters Equality Is Obligatory

The biggest condition in the case of multiple wives is justice. Many people think justice means weighing everything and making it equal, while others think there is no offence at all if the inclination of the heart is not equal. Both are incomplete. Let us see in light of the Qur'an and Sunnah what is obligatory and what is not.

Two Qur'anic verses: the condition and the reality

فَإِنْ خِفْتُمْ أَلَّا تَعْدِلُوا فَوَاحِدَةً

If there is a fear of being unable to be just, then one. — (Surah An-Nisa 4:3)

وَلَن تَسْتَطِيعُوا أَن تَعْدِلُوا بَيْنَ النِّسَاءِ وَلَوْ حَرَصْتُمْ ۖ فَلَا تَمِيلُوا كُلَّ الْمَيْلِ فَتَذَرُوهَا كَالْمُعَلَّقَةِ

No matter how hard you try, you will never be able to keep full equality (of the heart) between your wives. So do not incline completely to one side, leaving the other as if hanging. — (Surah An-Nisa 4:129)

The first verse makes justice a condition; the second makes clear the limit of human capacity: full equality of the heart's inclination is impossible, but leaning completely to one side in conduct is forbidden.

Matters in which equality is obligatory

1. Nights and the division of time (qasm)

Turns must be divided between the wives. In Hanafi fiqh, fixing an equal number of nights for each is generally preferred. Giving someone less time without reason, or avoiding a turn, is injustice.

2. Maintenance

In basic needs such as food, clothing and medical care, fair equality in standard must be kept. It is improper to keep one wife in abundance and the other in austerity.

3. Housing

Each wife should have safe housing with privacy — where possible a separate room or a separate unit. Two wives may not be kept in the same room without the wife's consent.

4. Conduct and respect

Fairness in speech, respect and behaviour. Criticising, insulting or comparing one wife in front of another must be avoided.

Matters in which equality is not required

  • The love of the heart: This is in Allah's hands. But it may not be expressed in a way that infringes the other wife's rights.
  • Slight variation in optional gifts — a slight difference in small gifts beyond the basic rights is not injustice, but if there is an intention to deprive someone, it is oppression; so the cautious course is to keep equality as far as possible.
  • A wife's willing concession — if someone gives up her turn or share.

The example of giving up a turn

Aisha (may Allah be pleased with her) narrates that when Sawda (may Allah be pleased with her) grew older, she gave her turn to Aisha (may Allah be pleased with her). The Messenger of Allah ﷺ would spend Sawda's day, together with Aisha's own day, with Aisha. (Sahih al-Bukhari 5212) From this we see that a concession made with a contented heart is valid; but extracting a concession by force, pressure or fear is not justice.

The grave consequence of leaning to one side

مَنْ كَانَتْ لَهُ امْرَأَتَانِ فَمَالَ إِلَى إِحْدَاهُمَا جَاءَ يَوْمَ الْقِيَامَةِ وَشِقُّهُ مَائِلٌ

Sunan Abi Dawud 2133; Jami' at-Tirmidhi 1141

The hadith makes clear that justice is not merely social etiquette; it is a matter of accountability in the Hereafter.

Practical advice

  1. Make a simple schedule and follow it.
  2. Keep a transparent monthly budget; note down for yourself how much is being spent on which need of which wife.
  3. Do not compare one wife in front of another.
  4. Keep equality among the children as well — see Raising children in a multi-wife family.
  5. In case of conflict, take the mediation of a scholar or an experienced elder — Marital disputes and arbitration.

A practical model for dividing time

In fiqh, the method of fixing the turns (qasm) is left to the husband, as long as it is equitable. Several models in practice:

  • A day-and-night turn: a fixed night in each household in rotation.
  • A weekly split: fixed days of the week in fixed homes.
  • Needs-based adjustment: a temporary change with the wives' consent in case of illness or a special need.

Discuss with the wives which model to use and make it clear; a written, or at least a clear verbal, understanding reduces future disputes.

On journeys and in emergencies

On which wife to take along on a journey, the jurists generally speak of keeping fairness through a draw or through the wives' consent; the basis for this is in the relevant chapter of Sahih al-Bukhari's Book of Marriage (Sahih al-Bukhari, Book of Marriage). Giving more time to a sick wife is not wrong if it is because of need and the balance is restored once she recovers.

Gifts and social dealings

For gifts on Eid, birthdays or special occasions, keep equality in basic maintenance. When giving financially large gifts (such as jewellery or property), it is better, for caution, to keep equality and transparency within the family.

Three "red flags" of justice

  1. Regularly avoiding a wife's phone contact or visits.
  2. Cutting the expenses of one household and overspending on the other.
  3. Using the children against one another, or criticising in front of them.

If such signs appear, stop, correct your conduct and, if necessary, take the help of arbitration (Marital disputes and arbitration).

For wives: a good way of asking for your rights

  • Instead of complaints, calmly state specific examples and needs.
  • Know your rights, but do not wish harm on the other wife (Handling co-wife jealousy).
  • In serious neglect there are legal and Shariah remedies (What a wife can do).

Must justice be exactly equal in every matter?

No. Equality is required in outward matters such as nights, basic maintenance, housing and conduct. Equality of the inclination of the heart or of emotion is beyond capacity, so it is not required, but one may not express it in action and thereby commit injustice.
