Is the First Wife's Permission Necessary for a Second Marriage? Shariah, Law and Ethics

The question is a very familiar one: does a second marriage need the first wife's permission? The answer cannot be given in one line, because there are three separate levels here — the ruling of Shariah, the law of the state, and moral responsibility. A just decision is possible only when all three are understood together.

1. In the view of Shariah

Verse 4:3 of Surah An-Nisa grants a man permission for plural marriage on the condition of justice; the verse does not make the first wife's permission a condition for the marriage to take place. For this reason, according to the majority of jurists, the second marriage takes place in Shariah even without the first wife's consent.

But Shariah is not silent about the wife's rights. There can be no shortfall in mahr, maintenance, housing and the division of time. The Qur'an's instruction:

وَعَاشِرُوهُنَّ بِالْمَعْرُوفِ ۚ فَإِن كَرِهْتُمُوهُنَّ فَعَسَىٰ أَن تَكْرَهُوا شَيْئًا وَيَجْعَلَ اللَّهُ فِيهِ خَيْرًا كَثِيرًا

Live with your wives in kindness. If you dislike them, it may be that you dislike something in which Allah has placed much good. — (Surah An-Nisa, 4:19)

2. In the view of Bangladeshi law

Under Section 6 of the Muslim Family Laws Ordinance, 1961, while an existing marriage subsists, another marriage cannot be contracted without the prior written permission of the Arbitration Council. The application must separately state the reason for the proposed marriage and whether the existing wife's consent has been obtained. If a man marries without permission, the full mahr of the existing wife must be paid immediately, and there are provisions for imprisonment or a fine. Many scholars view this law as an "administrative regulation of a mubah matter", which it is beneficial to follow — because it protects the wife's rights and reduces dishonesty. To avoid legal trouble, following the process is the wise course.

3. Moral responsibility

The Messenger of Allah ﷺ said:

خَيْرُكُمْ خَيْرُكُمْ لِأَهْلِهِ، وَأَنَا خَيْرُكُمْ لِأَهْلِي

The best of you is the one who is best to his family; and I am the best of you to my family. — (Jami' at-Tirmidhi 3895; Sunan Ibn Majah 1977)

Talking first with the first wife, who has kept the household for years, explaining the situation to her and ensuring her due rights is part of good conduct. If the Nikahnama has conditions

If any condition was written in the Nikahnama at the time of marriage (for example, what happens if the husband marries another), it should be honoured with respect. The hadith says:

إِنَّ أَحَقَّ الشَّرْطِ أَنْ يُوفَى بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ

The conditions most deserving to be fulfilled are those by which you made intimacy lawful (in marriage). — (Sahih al-Bukhari 2721; Sahih Muslim 1418)

A few words for wives

As a wife, you may be hurt by the situation — this is natural. Patience, mutual discussion and arbitration through an elder of the family or a scholar sometimes help to save the relationship (Marital disputes and arbitration). In discussions of Shariah and law, "permission" and "consent" appear as separate concepts:

  • Permission as a condition: whether the wife's permission is necessary for a second marriage to be valid — in Hanafi fiqh, according to the majority, it is not necessary.
  • Moral consent: dialogue and empathy to win the wife's heartfelt agreement — this is better according to the teaching of the Sunnah.
  • Opinion in the legal process: there is a representative of the wife on the Arbitration Council, and the application must give details of consent.

Understanding these three together avoids the wrong decision of "Shariah doesn't require it, so there's no need to tell her."

A possible structure for talking to the wife

  1. Introduction: begin with respect and gratitude towards her.
  2. A truthful account of the situation: why this decision, what you have thought about beforehand.
  3. A pledge: her rights, time, maintenance and dignity will not be diminished.
  4. Listening: listen attentively to her fears, objections and questions.
  5. Giving time: do not pressure her for an immediate answer.

If the wife objects strongly

  • Write down the reasons for the objection separately — which are real risks (financial, security) and which are emotional.
  • Show ways of solving the real risks.
  • Take the mediation of a trusted elder or scholar (arbitration).
  • Even if the wife is harsh, do not insult her or threaten revenge.

The wife's rights that will never be diminished

  • payment of the existing mahr (the due portion),
  • maintenance and housing,
  • a fair share of time,
  • the children's education and care,
  • dignity and privacy.

If the Nikahnama gives the wife the power of divorce or has any condition about a second marriage, read it and understand its effect through legal advice (Nikahnama).

According to the majority of jurists, yes, the marriage takes place. But if the Bangladeshi legal process is not followed there can be punishment and problems with registration, and the wife's rights may not be infringed.
