The Nikahnama and Marriage Registration: The Correct Process and Precautions in Bangladesh

In Shariah a marriage is valid through ijab-qabul in the presence of witnesses. But in today's state system, without legal proof of marriage, establishing the rights of the wife and children can be difficult. So alongside the nikah, correct registration is essential for both Shariah and legal protection.

Why registration is important

  • Proof of the wife's right to mahr and maintenance.
  • Protection of the child's paternity and inheritance.
  • Proof of the marital relationship for visas, passports and travel abroad.
  • A clear document at the time of plural marriage or divorce.

The Qur'an says marriage is a "solemn covenant":

وَأَخَذْنَ مِنكُم مِّيثَاقًا غَلِيظًا

And they (the wives) have taken from you a firm covenant. — (Surah An-Nisa, 4:21)

What is written in the Kabinnama

  • The names, ages and addresses of the groom, bride and witnesses.
  • The total amount of the mahr, the prompt and deferred portions.
  • Information about the wali / representative.
  • Conditions imposed on the marriage (if any).
  • The column on delegating the power of divorce to the wife and other prescribed columns.

Be sure to read what you are having written; do not leave any column unclear or blank. If a condition is written, the hadith stresses fulfilling it (The first wife's permission).

Under the Child Marriage Restraint Act 2017, the minimum age for marriage is 18 for women and 21 for men. Use the birth registration or NID to prove age. Concealing age or giving false information carries both legal and Shariah risk.

In the case of a second / third marriage

While an existing marriage subsists, another marriage cannot be registered without the permission of the Arbitration Council. First complete the relevant legal steps (The legal process of plural marriage in Bangladesh).

Notice of divorce and registration

When a divorce is given, under the Muslim Family Laws Ordinance 1961 notice must be given to the Chairman of the Union Parishad / Pourashava / City Corporation and a copy sent to the wife. Details: Talaq and khula: the rules.

Common mistakes to avoid

  1. Limiting oneself to "only ijab-qabul" without registering.
  2. Having the mahr written higher or lower — which will not actually be paid.
  3. Leaving the witnesses' details incomplete.
  4. Keeping the copy of the Kabinnama only with the husband.
  5. Marrying abroad and not verifying registration at home.

Fill in the columns of the Kabinnama understanding them

The Kabinnama is not just a paper; it is the legal document of the marriage. Read every column:

  • Identity of the parties: names, spelling, ages, addresses matched with the NID / birth registration.
  • Mahr: the total amount and the prompt-deferred split; the time of payment (if any).
  • Conditions: special conditions agreed in the marriage (such as housing, work, delegation of the power of divorce).
  • Witnesses: two adult, trustworthy persons, with signatures.
  • The Registrar's details: licence number, date, signature.

Correcting wrong information

If a mistake is noticed after registration, the rules of correction follow the instructions of the relevant office. So verify the names, spelling, ages and mahr correctly at the time of writing; once signed, correction can be troublesome.

If a copy is lost or proof is needed

The Nikah Registrar holds a copy of the registration book; there are rules for obtaining a certified copy. So keep several copies of the Kabinnama safely and save a digital scan.

Use for visas, passports and travel abroad

A registered proof of marriage is generally needed for a spouse visa, the child's birth registration and legal claims. For use abroad, attestation or translation of the certificate may be needed — check the rules of the relevant embassy / office (Marriage of expatriates).

Caution for women

  • If the marriage happens in the husband's absence or abroad, make sure until the Kabinnama is complete.
  • If the mahr is paid in cash, keep a receipt or written acknowledgement.
  • Do not sign suspicious or incomplete documents.
