Is a Secret Second Marriage Permissible? Shariah, Law and Ethics

Short answer: In Hanafi fiqh, if ijab-qabul is completed in the presence of two eligible witnesses, the marriage is valid. But publicity is the Sunnah, and secrecy for the purpose of deception or violating rights is improper and a cause of sin. In Bangladesh there is also a risk of punishment if the legal process is not followed.

1. From the viewpoint of fiqh

In the Hanafi madhhab, ijab-qabul and two witnesses are considered the minimum conditions for a marriage to be valid. In some madhhabs there is the view that if the witnesses are told to keep it secret, the marriage is not valid. Details: The pillars, conditions, witnesses and khutbah of the nikah.

2. The teaching of the Sunnah: publicity and announcement

فَصْلُ مَا بَيْنَ الْحَلَالِ وَالْحَرَامِ الدُّفُّ وَالصَّوْتُ

The difference between the lawful and the unlawful is the duff and the announcement (of the marriage). — (Jami' at-Tirmidhi 1088; Sunan an-Nasa'i 3369)

When a marriage is public, the child's identity, the wife's dignity and social security are protected. Secrecy sometimes invites slander and lack of rights.

3. Deception and violation of rights

مَنْ غَشَّنَا فَلَيْسَ مِنَّا

Whoever deceives us is not one of us. — (Sahih Muslim 101)

Concealing a marriage with the aim of depriving the first or second wife, the children or the family is deception. It is also wrong to keep the new wife in the dark about the earlier marriage.

4. The law of Bangladesh

If someone marries another while an existing marriage subsists without the written permission of the Arbitration Council, there is a provision for a fine / imprisonment, and such a marriage is not registrable. 5. When is secrecy harmful?

  • The second wife does not know that the husband is married.
  • The first wife's maintenance and time are shrinking.
  • Uncertainty over the child's paternity or inheritance.
  • The new wife becomes helpless in legal complications.

6. What is the right path

  1. Purify your intention; check the need and the means (Conditions of a second marriage).
  2. If possible, take the first wife into confidence and discuss (Permission).
  3. Complete the legal process.
  4. Hold a public nikah, walimah and registration.

Types of secrecy and their rulings

  • Secret from the first wife: the marriage can be valid, but there can be the sin of deception and violation of rights.
  • Secret from society (even with witnesses): the Sunnah of publicity is diminished; uncertainty in the child's identity and the wife's rights.
  • Secret from the law: the legal risk of marriage without permission and registration.
  • A condition of keeping witnesses secret: according to some madhhabs a question is raised over the marriage.

The harms that occur in practice

  1. The new wife suffers insecurity and lack of respect as a "secret wife".
  2. The child's birth registration and paternity become complicated.
  3. Proving inheritance after the husband's death is hard.
  4. If the first wife finds out later, the risk of breach of trust and the breaking of the household.
  5. The husband gets into trouble over a legal complaint.

The excuse of "social obstacles"

Some say that society will not accept it, so the marriage is done in secret. But choosing secrecy out of fear of society is often more harmful. Rather, going the way of discussion, patience and the legal route is balanced (Conditions of a second marriage).

Caution for women

If there is a condition such as "a secret marriage" or "the family cannot be told right now" in a proposal, verify the matter deeply. At the very least inform your own family and a trusted elder; do not agree to a marriage without written arrangements for registration and mahr.

A public nikah, registration, legal permission, informing the family and a plan for justice — without these five steps a second marriage is risky.
